TERMS OF SERVICE AGREEMENT
This Terms of Service Agreement (“Agreement”) is established between you (“User,” “you,” or “your”) and Web Host Era, registered under Company Number ———— (“Company,” “we,” “us,” or “our”). - You are responsible for providing accurate, current, and complete registration details, including an active email address that differs from your domain. If we need to contact you regarding abuse issues or account verification, we will use the primary email address on record.
- Keeping your contact details updated is your responsibility. Failure to maintain accurate and correct contact details (including domain-related information) may result in service disruptions. If needed, we may ask for verification via CNIC, phone call, or other means.
- If you purchase a dedicated server or require additional verification, we may request a government-issued ID and a credit card scan. Non-compliance may lead to order cancellation.
- You are responsible for all actions taken under your account and must ensure the confidentiality of your password and security information.
Web Host Era Content
All content provided through our Services, including but not limited to designs, text, graphics, images, videos, software, and other materials (referred to as “Web Host Era Content“), is the exclusive property of Web Host Era or its licensors.
Without explicit permission, you are not allowed to:
- Modify, copy, or distribute Web Host Era Content
- Reproduce, republish, or display it elsewhere
- Reverse engineer or extract source code
- Use the content beyond what is permitted under this Agreement
Unauthorized use automatically terminates your rights to the Services. All rights not expressly granted remain with Web Host Era and its licensors.
User Content
You can upload, store, publish, and distribute various types of User Content on our Services, including text, images, videos, and other materials (“User Content”). User Content also includes content posted by visitors of your website hosted on our platform (“User Websites”).
By posting User Content, you confirm that:
- You have the legal rights to distribute or publish it.
- Your content does not infringe on any third-party rights.
To provide the Services, you grant Web Host Era a non-exclusive, royalty-free, worldwide license to:
- Use, display, and publish your content
- Modify or translate content for better usability
- Create backups and store copies of your content
However, you retain full ownership of your content.
We do not monitor User Content, but if necessary, we reserve the right to:
- Remove content that violates this Agreement
- Suspend or terminate accounts involved in violations
- Take corrective actions if deemed necessary
Web Host Era is not responsible for any corrective actions taken.
User Content
Our Services do not comply with the U.S. Health Insurance Portability and Accountability Act (HIPAA).
- You are solely responsible for ensuring compliance with data privacy laws related to sensitive personal data.
- Our Services are not suitable for storing health records, children’s data, or medical information.
- We do not guarantee HIPAA compliance and are not liable for any data security issues regarding Protected Health Information (PHI).
- Users must not store or permit access to PHI on our Services. Doing so will lead to immediate account termination.
- Web Host Era does not sign Business Associate Agreements (BAAs) and is not considered a Business Associate under HIPAA.

If you fail to configure a 404 error page, Web Host Era will set up a default 404 page that may contain advertisements and third-party content.

Third-Party Products and Services
Third-Party Providers
We may offer third-party products and services, which are subject to the terms set by those third-party providers.
- Special discounts and promotions may come with restrictions imposed by the third party.
- We are not responsible for the quality, availability, or timeliness of these products or services.
- Any dealings with third-party providers are at your own risk.
Web Host Era as a Reseller or Sublicensor
We resell and sublicense certain third-party software, hardware, and services (“Resold Products”).
- Web Host Era is not responsible if third-party updates affect the performance of Resold Products.
- Any malfunctions or defects of Resold Products do not constitute a breach of our Agreement.
- Manufacturer warranties and terms apply to these products.
- Resold Products can only be used in connection with our Services and must not be modified, reverse-engineered, or resold.
Any violation of applicable laws regarding Resold Products is strictly prohibited.

Third-Party Websites
Our Services may include links to external websites that are not owned or controlled by us (“Third Party Sites”). Additionally, they may contain articles, images, text, graphics, designs, videos, and other content originating from third parties (“Third Party Content”). We do not take responsibility for any Third Party Sites or Third Party Content accessed through our Services. These external sites and content are not monitored, reviewed, or checked by us for accuracy, appropriateness, or completeness. If you choose to access any Third Party Site or use any Third Party Content, you do so at your own risk. Our terms and policies will no longer apply once you leave our Services. Prohibited Persons (Countries, Entities, and Individuals)
Our Services are subject to export control and economic sanctions laws enforced by the government of Pakistan. You are prohibited from using the Services to export or re-export any software or technical data in violation of Pakistani laws. Additionally, by accessing our Services, you confirm and guarantee that you are not:
(a) An individual, organization, or entity from a country or territory that is targeted by the Pakistani Armed Forces.
(b) Designated as a person of interest by Pakistani law enforcement agencies.
(c) Otherwise classified as a prohibited party under Pakistani laws.
(d) Engaged in terrorist activities or involved in nuclear, missile, chemical, or biological weapons-related activities without approval from the Government of Pakistan.
Unless explicitly authorized in writing, Web Host Era does not register or permit the use of its Services in connection with any Country-Code Top Level Domain Name (“ccTLD”) for any country or territory subject to government sanctions. These obligations will continue to apply even if your agreement with us ends or you stop using our Services.
Account Security and Web Host Era Systems
You are responsible for maintaining the security of scripts and programs installed under your account. This includes ensuring that directory permissions are correctly set, regardless of the installation method. We advise setting directory permissions to the most restrictive level possible.
As a user, you are accountable for all activities occurring under your account, including safeguarding your username and password. You must use a strong password. If a weak password is detected, your account may be suspended until you strengthen your password. We conduct periodic security audits, and if your password is found to be weak, we will notify you and provide time to update it before suspending your account.
Inode Limits
An inode is a data structure that stores information about a file within your hosting account. The number of inodes reflects the number of files and folders you have, including emails, stored files, and directories.
If an account surpasses 150,000 inodes, it will no longer be included in our courtesy backup system to prevent excessive resource usage. Any shared or reseller account exceeding 250,000 inodes may be restricted from writing data to disk. Failure to reduce inode usage may result in account suspension.
Our Services, including all related equipment and networks, are provided exclusively for authorized users. While we may monitor our systems to ensure compliance, security, and operational stability, we are not obligated to do so. By using our Services, you consent to such monitoring.
Unauthorized access to third-party networks or systems may lead to account suspension. If you need access to an external network, you must obtain written consent from the third party. We may require proof of authorization at our discretion.

Compatibility with the Services
You agree to cooperate with us to facilitate the provision of our Services. You are responsible for ensuring that you have the necessary software and hardware to use our Services. If our ability to fulfill our obligations depends on you performing certain tasks, we are not liable for any delays caused by your failure to do so.
Additionally, it is your sole responsibility to ensure that all User Content and User Websites are compatible with our systems, which may be updated periodically.
We do not guarantee backups of User Content. You must independently back up your data, including websites and other stored information, to prevent potential loss.
Billing and Payment Information
Prepayment
You are responsible for keeping your payment details up to date and ensuring that invoices are paid on time. Payments for our Services must be made in advance. At our discretion, we may apply payments to outstanding invoices within your billing account.
Auto-Renewal
Unless explicitly canceled, your Services may be automatically renewed to prevent disruptions. Charges may be processed using your saved credit card or other payment methods on file.
Advance Account
If you maintain a credit balance, it will be used for future purchases of our products and services. If your credit balance is insufficient to process an order, the order may not be completed. Any negative balance must be cleared within 24 hours, or we reserve the right to terminate the Services without notice.
Taxes
Our fees do not include any applicable sales, use, revenue, or excise taxes, including Federal and Provincial Sales Tax unless stated otherwise. Web Host Era strives to keep your contact information and preferences accurate. You have the right to request access to, correction, or deletion of your personal information unless we are required by law to retain it. We may decline requests that are frivolous, violate privacy laws, or are otherwise impractical.

Domain Payments
Domain Registrations
Once a domain is registered, it is non-refundable.
Domain Renewals
You can manage domain renewals by contacting us. While we may send renewal reminders as a courtesy, we are not responsible for any failure to renew a domain. Refunds will not be issued once a domain has been renewed.
Fraud
Misuse or fraudulent use of credit cards, bank transfers, electronic checks, or any other payment methods is strictly prohibited. Any fraudulent activity may be reported to relevant authorities, including law enforcement agencies, financial institutions, and credit bureaus.
Invoice Disputes

Web Host Era provides a thirty (30) day money-back guarantee for hosting services. If you are not satisfied and choose to terminate your account within the first thirty (30) days of signing up, you will receive a full refund for the amount paid for hosting services. Cancellations and Refunds

Non-Refundable Products and Services

- Administrative fees and taxes
- CodeGuard
- Digital Certificates
- Shared VPS hosting
- SiteLock installation fees
- Custom software and any other Web Host Era products or services
Cancellation Process
To cancel your services, contact our support team. Any fees and charges incurred before the cancellation date must be paid.
If you have pending orders when canceling your account, we will process them only if your Advance Account has sufficient funds. Otherwise, the orders will be canceled, and the charges will be reversed.
Web Host Era reserves the right to deny or cancel any order within thirty (30) days of processing. In such cases, we will refund any fees charged for the order.
Termination of Services
Web Host Era may terminate your access to services without prior notice if:
- You fail to pay fees when due.
- You violate this Agreement.
- Your actions harm Web Host Era or its users.
- Any other conditions outlined in this Agreement apply.
In such cases, fees paid in advance will not be refunded. Additionally, you will still be required to pay any outstanding charges for services used before termination. Web Host Era may also bill you for services for the remainder of the current term.

Resource Usage Policy
CPU, Bandwidth, and Disk Space
Shared hosting accounts should be used only for web files, active email, and website content. They must not be used for file storage, email archiving, or FTP hosting.
Web Host Era reserves the right to review accounts for excessive usage of CPU, disk space, and other resources. If an account violates this policy, we may suspend or terminate services or delete content.
Dedicated and VPS hosting services are limited by the allocated resources of the specific plan you purchase.
Important:
- At least 90% of your web pages must be linked to files hosted on Web Host Era’s servers.

Bandwidth usage is unmetered for shared hosting services only.
Reseller Terms and Responsibilities
Shared hosting accounts cannot be used to resell hosting services. If you want to resell hosting, you must purchase a Reseller Account.
Reseller Responsibilities
- Resellers must ensure that their clients follow this Agreement.
- Resellers are responsible for customer support, billing, and technical assistance for their users.
- Web Host Era does not provide support to reseller clients directly.
If a reseller’s client contacts Web Host Era for support, we may place the reseller’s account on hold until they resolve the issue.
Resellers are fully responsible for the actions and content of their clients. If a reseller’s client violates any laws or terms, the reseller may be held accountable.
Web Host Era reserves the right to update its reseller program at any time.
Limitation of Liability
Web Host Era, its directors, employees, and agents will not be liable for any indirect, consequential, incidental, or special damages, including lost profits or data loss, resulting from your use of our services.
Our total liability is limited to the amount you paid for services in the three (3) months before the issue arose.
Indemnification
You agree to defend, indemnify, and hold harmless Web Host Era, its affiliates, employees, and agents from any claims, losses, or damages resulting from:

- Any actions or omissions by you
Arbitration
Any disputes related to this Agreement will be resolved through arbitration in Islamabad, Pakistan, under The Arbitration Act 1940.
If a party faces irreparable harm from a breach of this Agreement, they may seek an injunction from a court of competent jurisdiction.
Independent Contractor Relationship
Web Host Era and users are independent contractors. This Agreement does not establish a partnership, joint venture, or principal-agent relationship between the parties.
Governing Law
This Agreement is governed by the laws of Pakistan. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Backups and Data Responsibility
Web Host Era does not maintain backups of dedicated accounts. Users are solely responsible for maintaining their own data backups.
Warranty Disclaimer
Web Host Era provides services “as is” and “as available”. We do not guarantee:

- Accuracy or reliability of provided information
We are not liable for any content transferred or stored through our services.
Entire Agreement

Severability
